Terms of Use
These Terms of Use ("Terms") govern your use of the satellite tracking service "SatFennek" (the "Service") operated by SatFennek Operations ("we", "us", or "our"). By using the Service, you agree to these Terms.
Article 1 — Scope
These Terms apply to all aspects of the relationship between you and us in connection with your use of the Service. In addition to these Terms, we may establish separate rules and guidelines ("Supplementary Rules") for the Service. Supplementary Rules form part of these Terms regardless of what they are called.
Article 2 — Registration
Some features of the Service are available without an account. To save observation logs and access certain other features, you must register by following the prescribed process.
We may decline a registration application if we determine that any of the following apply:
- False information was submitted in the application
- The applicant has previously violated these Terms
- We otherwise determine that registration is not appropriate
Article 3 — Account Management
You are responsible for managing your own account. You may not transfer or lend your account to any third party under any circumstances. We will treat any access that matches your registered credentials as access by you.
Article 4 — Prohibited Conduct
You must not engage in any of the following when using the Service:
- Acts that violate laws or public order and morals
- Acts related to criminal activity
- Acts that damage or interfere with our servers or network
- Acts that may obstruct the operation of the Service
- Collecting or accumulating personal information about other users
- Unauthorized access or attempts to gain unauthorized access
- Impersonating other users
- Directly or indirectly providing benefits to antisocial forces in connection with the Service
- Intentionally submitting false observation records
- Any other acts we deem inappropriate
Article 5 — Service Interruptions
We may suspend or interrupt all or part of the Service without prior notice to you if we determine that any of the following circumstances apply:
- Maintenance, inspection, or updates to the computer systems related to the Service
- Force majeure events such as earthquakes, lightning, fire, power outages, or natural disasters making it difficult to provide the Service
- Accidents causing a halt to computers or communication lines
- Any other circumstances in which we determine that providing the Service is difficult
Article 6 — Observation Data
Observation records you submit ("Saw it", "Missed it", etc.) may be used as community data after anonymization and aggregation. By submitting records to the Service, you consent to this use of your data.
Article 7 — Orbital Data
Satellite position predictions provided by the Service are calculated using TLE (Two-Line Element) data obtained from sources including CelesTrak. Predictions are for reference only and may differ from the actual position of a satellite. We make no warranty as to the accuracy of predictions.
Article 8 — Disclaimer
We are not liable for any breach of our obligations that does not result from our willful misconduct or gross negligence. We accept no responsibility for any transactions, communications, or disputes arising between you and other users or third parties in connection with the Service.
Article 9 — Changes to the Service
We may change, add to, or discontinue the content of the Service with prior notice to users, and you agree to this.
Article 10 — Changes to These Terms
We may amend these Terms without obtaining your individual consent in the following cases:
- When the amendment is in the general interest of users
- When the amendment is not contrary to the purpose of the Service agreement and is reasonable in light of the necessity of the change, the appropriateness of the amended content, and other circumstances
Article 11 — Privacy
The handling of personal information in connection with your use of the Service is governed by our Privacy Policy.
Article 12 — Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Japan. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over our principal place of business.
